China Individual tax update - Imminent challenge from Automatic Exchange of Financial Account Information (AEOI) and new "super" tax incentive for qualified equity plans (PwC speaker: Mr Louis Nam, Partner)

On 14 October 2016, the State Administration of Taxation (SAT) released the Discussion Draft on the Administrative Measures on the Due Diligence Procedures for Non-residents' Financial Account Information in Tax Matters to solicit public opinion. China and Hong Kong, as two of the 100+ countries / jurisdictions which have committed to implement Common Reporting Standard (CRS), will firstly exchange financial account information with its counterparts in year 2018. Under the CRS, the auto exchange of the financial account information will enable the tax authorities to have better access to the overseas financial account information of companies and individuals. The China tax authorities will also strengthen information collection to perform special tax review and audit on targeted industries, companies and high net worth taxpayers. The tax advisors will share the main audit focus of the tax authorities and the corresponding strategy for companies to manage the tax audits. Concurrently, the Chinese Ministry of Finance (MOF) and State Administration of Taxation (SAT) jointly released the Notice on Enhancement of the Income tax Policies for Equity Incentives and Equity Investment with Technology (Technology Investments) (Caishui [2016] No. 101, Circular 101) on 22 September 2016. The Circular provides deferral on the taxing point to the time of disposal for the qualified equity incentive plans of eligible domestic private companies. The Circular also offers tax deferral treatment for technology investments for domestic companies. The tax advisors will introduce and recommend how your companies could leverage on this "super" favourable income tax policy.

Asia Private Equity Forum 2017
